New “ICT” permit of stay for inter-company assignments now in force

Legislative Decree n. 253/2016 is now in force.
Such law provision rules the entrance and stay conditions for foreign citizens employed as executives, specialized workers and trainees within inter-company transfers, by adding to the Immigration Code article 27-quinquies on the entrance and stay of foreign employees resident outside of Italy and article 27-sexies with reference to employees already present in another EU Country, who are transferred in Italy by their Employer.
In the first case, employees are allowed to obtain a ICT permit of stay for Intercorporate transfers valid for all the assignment period, equal to three years for executives and specialized workers and one year for trainees, with the possibility of extension.
In the second case, the employees already having a ICT permit of stay released by another EU Country, must file the “presence declaration” with the Police Office for assignments lasting less than 90 days. For secondments lasting more than 90 days, it is not necessary to apply for the entry VISA and it is possible to start the working activity before the release of “nulla-osta”.
